Visa Faces Lawsuit Amid 'Vanilla' Gift Card Scam Allegations

Visa found itself entangled in a lawsuit as consumers alleged that the card payments network neglected to enhance the security of its prepaid "Vanilla" gift cards, making them susceptible to theft.

Ira Schuman, spearheading the proposed class action in a White Plains, New York federal court, claimed that he purchased eight $500 Vanilla cards as holiday gifts for his employees in 2022 and 2023, only to discover later that the cards had been emptied by unknown thieves.

The complaint highlighted that these non-reloadable debit cards, available at major retailers such as CVS, Target, Walgreens, and others, are sold in thin cardboard sleeves that can be easily tampered with. Thieves open the sleeves, record account information, and reseal them without detection. The stolen data is then used to monitor the card's activity on http://www.vanillagift.com, allowing the culprits to make purchases in a fraudulent scheme known as "card draining."

Schuman, residing in Scarsdale, New York, asserted that Visa, along with Vanilla card issuers Incomm Financial Services and Pathward Financial, were aware or should have been aware of the vulnerability of their cards but failed to implement additional security features. Moreover, the lawsuit claimed that the defendants did not offer refunds to victims of the theft.

Notably, this legal action follows a similar November lawsuit filed by San Francisco City Attorney David Chiu against Incomm, Pathward, and two card issuers over Vanilla cards. Interestingly, Visa was not named as a defendant in that case.

The Tuesday lawsuit accuses the defendants of violating a New York state law against deceptive and unfair consumer practices. It seeks compensatory and punitive damages for individuals who purchased Visa-branded Vanilla cards in New York since Jan. 30, 2021, and experienced funds being drained from their cards.

As of now, Visa, Incomm Financial Services, and Pathward Financial have not responded to requests for comment on the allegations. The legal proceedings shed light on the growing concern over the security of prepaid gift cards and the potential financial repercussions for consumers.
